Rules governing your use of the Amb. Ukur Yatani Official Website.

These Terms & Conditions (“Terms”) govern your access to and use of the Amb. Ukur Yatani Official Website (the “Website”, “Platform”, “we”, “our”, or “us”). By accessing or using the Website you agree to be bound by these Terms. If you do not agree, you must not use the Website.

1. Eligibility

  • You must be at least eighteen (18) years of age to register as a volunteer or make a donation.
  • You must be a Kenyan citizen, lawful resident of Kenya, or a person otherwise lawfully entitled to contribute to or volunteer for a political campaign in Kenya.
  • You must provide accurate, complete, and current information when interacting with the Website.

2. Acceptable Use

You agree NOT to:

  • Use the Website for any unlawful, fraudulent, or abusive purpose;
  • Submit false, misleading, defamatory, hateful, or impersonating content;
  • Attempt to interfere with, disrupt, or compromise the security of the Website, its infrastructure, or its users;
  • Use automated tools (bots, scrapers, crawlers) to harvest content or submit forms;
  • Attempt to gain unauthorized access to administrative areas, databases, or other users’ accounts;
  • Upload or transmit viruses, malware, or any code designed to cause harm.

Violations may result in immediate termination of access and referral to law-enforcement authorities under the Computer Misuse and Cybercrimes Act, 2018.

3. Volunteer Registration

  • Registration as a volunteer does not create an employment, agency, contractor, or partnership relationship with the campaign.
  • Volunteer activities are undertaken voluntarily and at your own initiative; the campaign provides no warranties of placement, role, compensation, or insurance unless expressly agreed in writing.
  • The campaign may approve, decline, suspend, or terminate a volunteer registration at its sole discretion.
  • Personal fundraising links issued to approved volunteers must be used in good faith, only to solicit lawful contributions, and never to misrepresent your relationship with the campaign.

4. Donations

  • All donations are voluntary contributions in support of the campaign.
  • You represent and warrant that the funds donated are lawfully yours and that the donation complies with the Election Campaign Financing Act and all applicable Kenyan electoral and anti-money-laundering laws.
  • Donations are not tax-deductible.
  • Donations are generally non-refundable. Refund requests for duplicate, erroneous, or fraudulent transactions may be considered at the campaign’s sole discretion and only where supported by evidence; approved refunds are returned via the original payment method, less any third-party processing fees.
  • Donations may not be accepted from anonymous foreign sources or any source prohibited by Kenyan law. The campaign reserves the right to refuse or return any contribution.
  • Recurring donations may be cancelled at any time by contacting us using the details below.

5. Payment Processing

Payments are processed by third-party payment service providers (mobile-money operators, card processors, and cryptocurrency networks). By submitting a donation you also agree to the terms of the relevant payment provider. We are not liable for failures, delays, or charges arising from the payment provider’s systems.

6. Merchandise & Shop

  • Prices are quoted in Kenya Shillings (KES) unless stated otherwise and may change without notice;
  • Orders are subject to availability and acceptance by the campaign;
  • Shipping timelines are estimates, not guarantees;
  • Returns and exchanges are accepted only for defective or incorrect items, reported within seven (7) days of receipt.

7. Intellectual Property

All content on the Website — including text, graphics, logos, photographs, video, code, and trademarks — is owned by or licensed to the campaign and is protected by Kenyan and international intellectual-property laws. You may not copy, reproduce, distribute, publish, or create derivative works without prior written permission, except for personal, non-commercial viewing.

8. User-Submitted Content

By submitting any content to the Website (messages, comments, survey responses, poll votes, photos for galleries, etc.) you grant the campaign a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, and publish that content for campaign purposes. You warrant that the content is yours to submit and does not infringe any third-party rights.

9. Cookies and Tracking

The Website uses cookies and similar technologies as described in the Privacy Policy. By continuing to use the Website after being shown the cookie notice, you consent to non-essential cookies; you may withdraw that consent at any time via the cookie banner controls or your browser settings.

10. Third-Party Links and Services

The Website may link to third-party websites or services (social media, payment providers, live-chat). We do not control and are not responsible for the content, policies, or practices of those third parties. Accessing them is at your own risk.

11. Disclaimers

The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses.

12. Limitation of Liability

To the maximum extent permitted by Kenyan law, the campaign, its officers, agents, contractors, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, goodwill, or opportunity, arising out of or in connection with your use of the Website. Our aggregate liability for any direct damages shall not exceed the amount you have paid to the campaign in the six (6) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless the campaign and its representatives from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.

14. Suspension and Termination

We may suspend or terminate your access to the Website, your volunteer registration, or your account, with or without notice, if we believe you have breached these Terms or applicable law, or if such action is necessary to protect the Website, its users, or the campaign.

15. Changes to These Terms

We may update these Terms from time to time. Updates take effect immediately upon publication on the Website unless stated otherwise. Continued use of the Website after publication constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya, sitting in Nairobi.

17. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the campaign regarding the Website.
